{"id":12131,"date":"2025-06-06T12:00:00","date_gmt":"2025-06-06T16:00:00","guid":{"rendered":"https:\/\/cov19longhaulfoundation.org\/?p=12131"},"modified":"2025-06-05T12:02:16","modified_gmt":"2025-06-05T16:02:16","slug":"texas-house-oks-bill-to-sue-vaccine-makers-for-false-ads","status":"publish","type":"post","link":"https:\/\/cov19longhaulfoundation.org\/?p=12131","title":{"rendered":"Texas House OKs Bill To Sue Vaccine Makers for False Ads"},"content":{"rendered":"\n<p class=\"has-small-font-size\"><em>Authored by Jon Fleetwood via substack,<\/em><\/p>\n\n\n\n<p><strong>In a major victory for accountability and informed consent,<\/strong>\u00a0the Texas House of Representatives passed\u00a0<strong><a href=\"https:\/\/legiscan.com\/TX\/bill\/HB3441\/2025\">HB 3441<\/a><\/strong>\u00a0yesterday, a bill that would allow Texans to sue vaccine manufacturers whose advertising leads to injury or harm<\/p>\n\n\n\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/kvnqi27ncqj.2407010717550.jpg?itok=3qRxY1gC\"><\/a>The unprecedented move comes as CDC data\u00a0<a href=\"https:\/\/openvaers.com\/\">show<\/a>\u00a0there have been an alarming\u00a0<strong>2,665,796 adverse events linked to vaccines<\/strong>\u00a0since 1990, the vast majority related to COVID-19 jabs.<\/p>\n\n\n\n<p>But if fewer than 1% of adverse events are reported &#8211; as a 2010 HHS-funded Harvard&nbsp;<a href=\"https:\/\/digital.ahrq.gov\/sites\/default\/files\/docs\/publication\/r18hs017045-lazarus-final-report-2011.pdf\">analysis<\/a>&nbsp;confirms &#8211; the&nbsp;<strong>real number could exceed 266 million<\/strong>, or roughly 7.6 million per year, or 20,800 per day.<\/p>\n\n\n\n<p>First filed in February, the new bill passed yesterday by a vote of&nbsp;<strong>88\u201331<\/strong>, moving the legislation one step closer to becoming law.<\/p>\n\n\n\n<p>The pioneering legislation boasts a whopping&nbsp;<strong>79 brave sponsors<\/strong>, 74 Republicans and 5 Democrats.<\/p>\n\n\n\n<p>The bill is spearheaded by Representatives Shelley Luther (R-62), Jeff Leach (R-67), Marc LaHood (R-121), Oscar Longoria (D-35), and Mike Schofield (R-132).<\/p>\n\n\n\n<p>If you want this kind of bill passed in your state or at the federal level, you can&nbsp;<a href=\"https:\/\/www.usa.gov\/elected-officials\">find your local, state, and U.S. representatives here<\/a>&nbsp;and let them know.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/inline-images\/httpssubstack-post-media.s3.amaz%20%2810%29_7.jpg?itok=RpGxLmN8\" alt=\"\"\/><\/figure>\n\n\n\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/httpssubstack-post-media.s3.amaz%20%2810%29_7.jpg?itok=RpGxLmN8\"><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What the Bill Does<\/strong><\/h2>\n\n\n\n<p>Texas House Bill 3441, titled&nbsp;<em>\u201cRelating to the liability of vaccine manufacturers that advertise a harmful vaccine,\u201d<\/em>&nbsp;holds pharmaceutical companies liable if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They\u00a0<strong>advertise a vaccine<\/strong>\u00a0in Texas through paid promotion, and<\/li>\n\n\n\n<li>That\u00a0<strong>advertised vaccine causes injury or harm<\/strong>\u00a0to an individual.<\/li>\n<\/ul>\n\n\n\n<p>In short: if a vaccine manufacturer pushes a product through ads\u2014and that product ends up causing harm\u2014they can be sued for it in court.<\/p>\n\n\n\n<p>The bill defines \u201cadvertising\u201d broadly to include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Television and radio ads<\/strong><\/li>\n\n\n\n<li><strong>Print media and digital media<\/strong><\/li>\n\n\n\n<li><strong>Product placements and influencer promotions<\/strong><\/li>\n<\/ul>\n\n\n\n<p>But&nbsp;<strong>excludes<\/strong>&nbsp;materials inside a clinical setting or direct conversations between doctors and patients.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legal Ramifications<\/strong><\/h2>\n\n\n\n<p>HB 3441 creates a clear legal pathway for Texans to bring a civil action against vaccine manufacturers\u2014<strong>up to three years<\/strong>&nbsp;after the injury occurs.<\/p>\n\n\n\n<p>If the injured party prevails in court, the manufacturer is required to pay:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Actual damages<\/strong><\/li>\n\n\n\n<li><strong>Court costs<\/strong><\/li>\n\n\n\n<li><strong>Attorney\u2019s fees<\/strong><\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/inline-images\/httpssubstack-post-media.s3.amaz%20%2811%29_7.jpg?itok=0VcF262L\" alt=\"\"\/><\/figure>\n\n\n\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/httpssubstack-post-media.s3.amaz%20%2811%29_7.jpg?itok=0VcF262L\"><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why This Matters<\/strong><\/h2>\n\n\n\n<p>For decades, vaccine manufacturers have enjoyed near-total immunity from liability thanks to federal protections under the&nbsp;<strong>National Childhood Vaccine Injury Act of 1986<\/strong>&nbsp;and the&nbsp;<strong>PREP Act<\/strong>.<\/p>\n\n\n\n<p>But HB 3441 cuts through that shield\u2014<strong>not by targeting the product itself<\/strong>, but by going after the&nbsp;<strong>promotional lies used to sell it<\/strong>.<\/p>\n\n\n\n<p>Cleverly, the bill\u2019s authors appear to be leveraging the&nbsp;<strong>advertising hook<\/strong>&nbsp;as a legal workaround to federal immunity, holding companies accountable for the&nbsp;<strong>claims<\/strong>&nbsp;they make, not merely the product they produce.<\/p>\n\n\n\n<p>This represents a&nbsp;<strong>massive legal shift<\/strong>.<\/p>\n\n\n\n<p>If HB 3441 becomes law, Texas could become the first state in the nation to&nbsp;<strong>strip vaccine manufacturers of their immunity\u2014at least when it comes to deceptive advertising that leads to harm<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What\u2019s Next<\/strong><\/h2>\n\n\n\n<p>The bill is now classified as&nbsp;<strong>\u201cengrossed,\u201d<\/strong>&nbsp;meaning it\u2019s cleared the House and is headed to the Texas Senate for consideration.
