Human beings made decisions about coronavirus research, laboratory experimentation, government financing, regulatory compliance, laboratory safety, scientific communications, and disclosure of information. Those decisions must be examined for their consequences and, where appropriate, for their legality.

The central question is no longer whether scientists had the technical ability to manipulate coronaviruses.

They did.

The central question is whether government-funded researchers and their institutional supervisors knowingly conducted or supported research that unnecessarily increased the capacity of potentially dangerous viruses to infect humans, whether applicable safeguards and laws were deliberately circumvented, and whether officials subsequently concealed information about those activities.

If the evidence establishes those facts, criminal prosecution is warranted.

The Ethical Boundary

There is an elementary principle that should govern biological research:

The fact that scientists can perform an experiment does not establish that they should perform it.

Research involving pathogens capable of causing severe human disease carries consequences fundamentally different from ordinary laboratory experimentation.

If researchers deliberately alter a pathogen to increase characteristics such as infectivity, host range, immune evasion, transmissibility, or pathogenicity, the scientific justification must be extraordinarily compelling and the safeguards correspondingly extraordinary.

The question is not simply whether an experiment produces interesting scientific information.

The question is whether the information gained justifies creating or increasing a biological hazard capable of escaping the laboratory and causing catastrophic consequences.

Where the answer is no, conducting the experiment can become an exercise in creating risk rather than reducing it.

The Coronavirus Research Program

The United States government funded coronavirus research before the pandemic, including research conducted through EcoHealth Alliance and involving the Wuhan Institute of Virology.

The existence of that funding is not disputed.

Nor is the existence of federal policies governing certain categories of potentially dangerous pathogen research.

The 2014 U.S. government funding pause addressed specified research involving influenza, SARS, and MERS viruses where the experiments could reasonably be anticipated to increase pathogenicity or transmissibility in mammals. (grants.nih.gov)

The existence of those restrictions establishes something important: the U.S. government itself recognized that certain forms of pathogen enhancement presented risks sufficiently serious to warrant restricting federal funding.

That policy framework makes subsequent questions about whether particular coronavirus experiments fell within those restrictions highly consequential.

Circumvention Is Not the Same as Scientific Disagreement

The most serious issue is not whether scientists disagreed about the meaning of “gain of function.”

Scientists may reasonably disagree about terminology, experimental classification, and regulatory categories.

The more serious question is whether individuals deliberately structured research or communications to avoid regulatory requirements that they understood applied to their activities.

There is an enormous difference between:

“We concluded in good faith that this experiment did not fall within the regulatory definition.”

and:

“We knew the requirement applied and deliberately created a mechanism to avoid it.”

The first is a regulatory disagreement.

The second can constitute evidence of intentional evasion and, depending upon the applicable statute and evidence of intent, potentially criminal conduct.

That distinction should be the central focus of the investigation.

The Morens Guilty Plea

The federal prosecution of David Morens provides a concrete example of intentional concealment.

On August 18, 2026, Morens pleaded guilty to conspiracy to commit offenses and to defraud the United States in connection with a scheme to evade FOIA and Federal Records Act requirements concerning communications about coronavirus research grants. (justice.gov)

According to the Department of Justice, Morens and a co-conspirator deliberately used Morens’s personal Gmail account rather than government systems because they anticipated FOIA requests.

The conduct involved government-related communications that should have been created, maintained, and exchanged through government systems.

The guilty plea therefore establishes intentional concealment by Morens.

It is not necessary to speculate about whether the concealment was accidental.

It was criminal conduct to which he pleaded guilty.

The Significance of the Concealment

The subject matter of the concealed communications makes the case particularly serious.

The federal investigation concerns communications about coronavirus research grants.

The government has alleged that the scheme involved efforts concerning the EcoHealth research program and efforts to counter alternative explanations for the origins of COVID-19. The April 2026 indictment charged Morens with conspiracy, destruction or falsification of records in federal investigations, concealment or mutilation of records, and aiding and abetting. (justice.gov)

The question therefore becomes unavoidable:

What was being concealed, who knew it was being concealed, and why?

Those questions should be answered through forensic examination of every available record.

The Illegal-Gratuity Evidence

The guilty plea also introduced another category of conduct.

According to DOJ, Morens admitted participating in a conspiracy involving illegal gratuities. The government states that a co-conspirator provided Morens wine and discussed providing other valuable benefits, while Morens identified an official act he could perform to “deserve” the gift—including authoring a scientific commentary advocating a natural origin of COVID-19. (justice.gov)

If established according to the terms of the plea, this provides a concrete example of a federal scientific official’s private interests intersecting with scientific communications concerning the origin of the pandemic.

That conduct warrants examination independently of whether the natural-origin hypothesis ultimately proves correct.

A scientific conclusion should never be purchased.

The Fauci Question

Anthony Fauci was the director of NIAID during the relevant period.

The agency funded coronavirus research and exercised substantial authority over the scientific and administrative programs at issue.

Morens was a senior NIAID adviser.

Communications released during congressional investigations have raised questions concerning private-channel communications involving Fauci and Morens.

Those communications warrant investigation.

The appropriate question is not whether Fauci should receive the benefit of his reputation.

It is whether the evidence establishes what he knew, what he approved, what he communicated, what records he received, and what actions he took.

If investigators establish that Fauci knowingly participated in an effort to evade federal recordkeeping requirements, conceal government business, circumvent legal restrictions, or suppress material evidence, he should be prosecuted under the statutes applicable to the proven conduct and tried for Crimes Against Humanity.

If investigators establish that other government officials, researchers, university personnel, contractors, or corporate executives knowingly participated in equivalent conduct, the same standard should apply to them.

No scientific credential should create immunity from criminal law.

The UNC Question

The investigation should likewise examine the role of the University of North Carolina and researchers involved in coronavirus engineering and reverse-genetics work.

UNC researchers have conducted extensive coronavirus research and developed technologies capable of manipulating coronavirus genomes.

The existence of that technical capability is established.

The question requiring investigation is whether any particular experiments were conducted within applicable federal requirements, whether their risks were properly assessed, whether funding restrictions were complied with, and whether representations made to federal authorities accurately described the nature and consequences of the experiments.

Where evidence establishes compliance, that should be documented.

Where evidence establishes deliberate circumvention, that should likewise be documented.

The objective should be criminal accountability based upon evidence—not institutional protection.

The Biological-Weapons Question

The proposition that deliberate manipulation of a pathogen to increase infectivity or virulence can create a biological-weapons-level hazard deserves serious consideration.

That does not establish that SARS-CoV-2 was deliberately created as a biological weapon.

But deliberately increasing the capacity of a pathogen to infect or cause disease in humans can create a hazard with obvious similarities to biological-weapons risk, regardless of the stated scientific purpose.

A researcher does not eliminate that hazard by calling the experiment “basic science.”

Intent matters legally.

Risk matters scientifically.

Consequences matter ethically.

And the absence of malicious intent does not necessarily eliminate responsibility for reckless conduct.

What the Genome Does—and Does Not—Establish

SARS-CoV-2 contains a polybasic furin-cleavage site in its spike protein. Experimental studies demonstrate that the site affects viral replication, tissue tropism, and pathogenesis.

These findings establish the biological importance of the feature.

That evidence must be included in a serious investigation.

It does not, however, resolve the broader laboratory question.

A virus can theoretically be associated with laboratory research without being deliberately engineered.

A laboratory accident and a biological weapon are not synonymous.

Deliberate engineering and accidental release are not synonymous.

Those possibilities must be investigated separately.

The Missing Evidence

The investigation therefore should not be limited to published papers.

It should encompass:

laboratory notebooks;

unpublished sequences;

original virus databases;

sample inventories;

laboratory personnel records;

biosafety records;

experimental protocols;

grant applications;

grant amendments;

communications concerning regulatory classification;

communications concerning gain-of-function research;

EcoHealth records;

Wuhan Institute of Virology records;

UNC research records;

government grant-review records;

private email accounts;

deleted communications;

and communications concerning the origin of SARS-CoV-2.

The WHO SAGO investigation has stated that substantial information necessary to evaluate the competing origin hypotheses has not been provided, including information concerning laboratory work and biosafety conditions in Wuhan. WHO therefore continues to state that both zoonotic spillover and laboratory-associated hypotheses remain under consideration. It i self-serving on the part of the scientists at Wuhan, the Chinese government, NIAIDS, Fauci, UNC, EcoHealth Alliance, Drazik and other U.S. government officials to avoid sunlight and suppress any information that would indict their crimes that killed millions.

That missing evidence is not an argument for any particular conclusion but it needs to be provided to determine the truth.

It is an argument for obtaining the evidence.

A Call for Criminal Investigation and Prosecution

The appropriate response to evidence of deliberate criminal conduct is not another scientific panel, another press conference, or another institutional report.

It is criminal investigation.

Where the evidence establishes probable cause, prosecutors should seek indictments.

Where indictments are supported by admissible evidence, defendants should be brought to trial.

Where guilt is established beyond a reasonable doubt, appropriate criminal penalties should follow.

And where the evidence establishes conduct satisfying the legal elements of crimes against humanity or other applicable international crimes, prosecutors and competent international authorities should pursue those charges as well.

That standard must apply without regard to whether the accused is a government official, university professor, physician, pharmaceutical executive, government contractor, or internationally celebrated scientist.

No Immunity for Scientific Elites

The extraordinary status of the people involved should make accountability more important, not less.

The COVID-19 pandemic demonstrated the enormous power possessed by modern biomedical institutions.

The same institutions can develop vaccines, antivirals, diagnostic technologies, and life-saving treatments.

They can also create extraordinary biological risks.

Scientific capability is not a defense to criminal conduct.

Government employment is not a defense.

A prestigious university affiliation is not a defense.

A medical degree is not a defense.

A federal grant is not a defense.

And the assertion that research was conducted for legitimate scientific purposes is not, by itself, a defense to deliberately violating criminal law.

The governing principle should be simple:

Science does not stand above the law.

The Standard That Should Apply

The investigation should therefore proceed on two parallel tracks.

The first should determine the origin of SARS-CoV-2 using all available scientific and intelligence evidence.

The second should determine whether individuals knowingly violated laws, regulations, grant conditions, public-record requirements, biosafety requirements, or criminal statutes while conducting or concealing coronavirus research.

The two questions are related but should not be confused.

Even if SARS-CoV-2 ultimately proves to have arisen through natural spillover, which is less likely with each recent discovery, individuals who knowingly committed crimes during coronavirus research or subsequently concealed government records remain responsible for those crimes.

Conversely, if evidence ultimately demonstrates that SARS-CoV-2 resulted from a laboratory-associated event, and if investigators establish that the event resulted from unlawful or reckless research practices, the consequences would be vastly more serious.

And if evidence were ultimately to establish deliberate creation or release of a pathogen for the purpose of causing widespread human disease, the appropriate legal characterization would be correspondingly grave.

That is precisely why the underlying evidence must be preserved and examined.

The Moral Imperative

Millions of people died.

The world experienced a pandemic of historic magnitude.

The United States government funded high-risk coronavirus research.

Researchers possessed the technological capacity to manipulate coronavirus genomes.

Federal rules existed to govern some categories of dangerous pathogen research.

Questions arose concerning compliance with those rules.

Important information concerning laboratory research remains unavailable.

And a senior NIAID official has now pleaded guilty to a federal conspiracy involving deliberate concealment of government communications concerning coronavirus research grants.

Those facts justify a level of investigation commensurate with the consequences.

The objective should not be revenge.

It should not be political retaliation.

It should not be protection of institutions.

It should be accountability.

If the evidence shows that people knowingly endangered the public through unlawful biological experimentation, they should be prosecuted.

If the evidence shows that people knowingly concealed that conduct, they should be prosecuted.

If the evidence shows that officials knowingly participated in a conspiracy to evade federal law, they should be prosecuted.

And if the evidence establishes conduct meeting the legal definition of crimes against humanity, those responsible should face prosecution for those crimes with dire consequence.

The scientific establishment cannot be permitted to operate under a different moral or legal standard from everyone else.

The principle is as old as civilization:

The ability to do something does not create the right to do it.

And when the thing being done creates the possibility of unleashing a pathogen capable of killing millions of people, the burden of justification must be extraordinarily high.

Where that burden was not met—and where criminal conduct can be established—the appropriate response is not another apology, another bureaucratic review, or another defense of institutional reputation.

It is prosecution for Crimes Against Humanity.

John Murphy, CEO The COVID-19 Long haul Foundation The scale of the COVID-19 catastrophe demands a fundamentally
